Obama vs. Marbury v. Madison
President Obama is a former president of the Harvard Law Review and famously taught constitutional law at the University of Chicago. But did he somehow not teach the historic case of Marbury v. Madison? That's a fair question after Mr. Obama's astonishing remarks on Monday at the White House when he ruminated for the first time in public on the Supreme Court's recent ObamaCare deliberations. "I'm confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress," he declared. Presidents are paid to be confident about their own laws, but what's up with that "unprecedented"? In Marbury in 1803, Chief Justice John Marshall laid down the doctrine of judicial [...]
Obama calls SCOTUS “unelected group of people”
(Reuters) - President Barack Obama took an opening shot at conservative justices on the Supreme Court on Monday, warning that a rejection of his sweeping healthcare law would be an act of "judicial activism" that Republicans say they abhor. Obama, a Democrat, had not commented publicly on the Supreme Court's deliberations since it heard arguments for and against the healthcare law last week. Known as the "Affordable Care Act" or "Obamacare," the measure to expand health insurance for millions of Americans is considered Obama's signature domestic policy achievement. A rejection by the court would be a big blow to Obama going into the November 6 presidential election. Republican presidential candidates, who are vying to take on Obama in November elections, have promised to [...]
Obamacare Judicially Reviewed
Pete Spiliakos provides a nice review of Solicitor General Verrilli’s attempts to defend Obamacare in front of the Supreme Court this past week (“What Part of ‘Because I Said So’ Don’t You Understand?”). Most tv and print pundits say the government’s lawyers (Verrilli) did a poor job defending the law in front of the court and many blame Verrilli personally. In the final analysis however …Solicitor General Verrilli did his pitiful tap dance about how the health care market is “different” and how the federal government has the power to compel you to buy health insurance but not a cell phone or burial insurance. And the result was that the more conservative Justices pounded him into the ground. The problem wasn’t Verrilli. It was the quality of his [...]
Video: Religious freedom is just the first casualty of Obamacare
Ever since the Obama administration in January reiterated that religious employers — against their religious convictions – will have to provide employee insurance that covers contraception, the so-called contraception mandate has been at the forefront of a debate about religious liberty. That was as it should be. Now, though, it’s time to remember that the mandate is not just a violation of religious liberty; it’s also the first concrete evidence that Obamacare violates our liberties in general. As Ed wrote yesterday, the majority of Americans still favor a complete repeal of the Affordable Care Act. That repeal would necessarily entail a repeal of the contraception mandate. Given that, opponents of Obamacare must be careful not to substitute a part for the whole. An [...]
Obama Choosing To Ignore ObamaCare Won’t Make It Disappear
OBAMA BARELY MENTIONED HIS SIGNATURE ACHIEVEMENT DURING HIS STATE OF THE UNION SPEECH "President Obama Made Only Glancing References To Health Care Reform During His State Of The Union Address Tuesday Night." (Sam Baker, "Obama Largely Avoids Healthcare In State Of The Union," The Hill's "Healthwatch," 1/24/12) Politico's Jennifer Haberkorn: "The Health Care Reform Law … Obama's Most Significant Domestic Policy Accomplishment … Only Got A Fleeting Mention Tuesday In His Third State Of The Union Speech." "President Barack Obama used his State of the Union speech to remind voters that his administration killed Osama bin Laden and rescued General Motors. But that big health care law he spent a year pushing through Congress didn't get much play. The health care reform law, which [...]
SCOTUS Sets Dates for Obamacare Individual Mandate Oral Hearings
The Supreme Court of the United States (SCOTUS) has set dates for Oral arguments on Obamacare's Individual mandate. The lawsuit was filed by Florida and two dozen other states stating that the law, which requires individuals to purchase health insurance is unconstitutional. The law could also fund abortions with taxpayer dollars. The Supreme Court has set aside five and a half hours of hearings between March 26 and March 28. SCOTUS Schedule: March 26th - An hour has been set aside to hear an hour of argument over whether a Reconstruction-era federal statute, the Anti-Injunction Act, bars the justices from making a decision on the individual mandate's constitutionality until after the provision goes into effect in 2014. The Anti-Injunction Act, 28 U.S.C.§ 2283, is a [...]
Huffpo Pipe Dreams – The Republicans Could Lose South Carolina

Bachmann goes Nuclear in New Ad No Surprises 2012 'Don't Settle'
With Michele Bachmann, there are no policy flip-flops. There's no need to compromise on one of the issues that matters to you. She means what she says, and she says what she means. via Don't Settle: NoSurprises2012.com - YouTube. abcnews GOP contender Rep. Michele Bachmann released a web ad Tuesday attacking most of her Republican competition for switching positions on policies, or avowing ideas that are not in lock step with conservative ideology. The ad titled “No Surprises 2012″ opens with the question: “Who is the consistent conservative?” It then cobles video clips of her competition being less than “consistently conservative,” starting with former Massachusetts Gov. Mitt Romney saying, “I believe abortion should be safe and legal in this country” and “I will [...]
