O.K. up to now the argument has been academic and sparsely cited with quotes.  But now, some documents are coming to light on Supreme Court nominees first Amendment beliefs.  A belief that speech on racial or gender inequality should be quashed and how speech should be weighed against social costs sounds good for some.. but depending on who is in power, ones interpretation of that could be skewed politically.  I am not sure someone should sit on the Supreme court who believes in limiting speech to this degree The duty of a Supreme Court Justice is to uphold our Constitutional liberties — unless that Justice is appointed by B. What the photo shows tells me is  Kagan has a great open stance that shows she knows how to play Softball.  I didn't know all female softball players were gay... heck did I waste my time gawking at the softball players during college?  All this time I thought I wasn't appealing. I don't care if Kagan is Gay, straight, black, white, from new york, or a Jew.... What I do care about is how she would rule as a Judge.  That information is what is lacking.   One thing is for sure, she will be hoping for 'soft-ball' questions during her confirmation process. What is liberal enough for the media anyway?  Chairman Mao?  This is a Left wing Political strategist tactic that is so old.  Introduce in the media that the nominee, "may not be liberal enough" so the right might give in on a fight for confirmation. Already we see she a few negatives out there.  She was not a fan of don't ask, don't tell that was the law of the land under President Clinton.  How did she respond?  She took it out on the Military by keeping recruiters off campus.  She has almost no case law history.  What we do have is a few writings were she said that socialism's failure was "sad". Right leaning folks shouldn't buy this elementary attempt to paint her as a Moderate.  Watch out for the Senators, as with Sotomayor, to tout her personal story rather than here [...]
