Judge uses Obama’s own words against him on Health Care Individual Mandate
In ruling against President Obama‘s health care law, federal Judge Roger Vinson used Mr. Obama‘s own position from the 2008 campaign against him, arguing that there are other ways to tackle health care short of requiring every American to purchase insurance. “I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that ‘if a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge Vinson wrote in a footnote toward the end of the 78-page ruling Monday. Breaking: Judge: Obama Health-Care Reform Act Unconstitutional
President Barack Obama’s health care reform legislation, assailed as an abuse of federal power in a 26-state lawsuit, was ruled unconstitutional by a U.S. judge. U.S. District Judge Roger Vinson in Pensacola, Florida, declared the law unconstitutional in a ruling today. Then- Florida Attorney General Bill McCollum filed suit on behalf of 13 states on March 23, the same day Obama signed into law the legislation intended to provide the U.S. with almost universal health-care coverage. Seven states joined the litigation last year, and six signed on this year. Virginia Attorney General Kenneth Cuccinelli sued separately on March 23 and Oklahoma Attorney General Scott Pruitt filed his own suit on Jan. 21. Florida Health Care Ruling Expected Monday
The fourth federal judge to rule on President Obama's health care law is expected to issue his decision from Florida Monday. U.S. District Judge Roger Vinson's ruling will decide the biggest of the many court challenges to Obama's hallmark accomplishment, which now has 26 state attorneys general backing the suit. Opponents of the Affordable Care Act specifically target two key aspects of the law. First, that the "individual mandate," which requires every American have health insurance (or suffer a tax penalty) exceeds the constitutional powers of Congress and violates the Commerce Clause. SEIU Drops Health Coverage for Workers’ Children
One of the largest union-administered health-insurance funds in New York is dropping coverage for the children of more than 30,000 low-wage home attendants, union officials said. The union blamed financial problems it said were caused by the state’s health department and new national health-insurance requirements. The fund is administered by 1199 SEIU United Healthcare Workers East, an affiliate of the Service Employees International Union. Union officials said the state compelled the fund to start buying coverage from a third party, which increased premiums by 60%. State health officials denied forcing the union fund to make the switch, saying the fund had been struggling financially even before the switch to third-party coverage. Fifty-three percent now trust GOP More on Health Care Issues
Following the passage of the health care bill, 53% now say they trust Republicans on the issue of health care. Thirty-seven percent (37%) place their trust in Democrats. A month earlier, the two parties were essentially even on the health care issue. These results are consistent with the finding that 54% of voters want the health care bill repealed. Rasmussen Reports is tracking support for repeal on a weekly basis. Still, health care ranks just number five among voters on the list of 10 important issues. The economy remains the top issue of voter concern as it has been for over years. On the economy, Republicans are trusted more by 49% while Democrats are preferred by 37%. SC Senator Jim DeMint vows to fight health-care legislation, Congressman Clyburn calls him Deminted
One would think that after the alledged racial epitapes toward Congressman Clyburn and the Civil Rights hero John Lewis, the Democratic Whip running high off their win on the health care legislation he would be a bit careful how he uses his own language.
